Riba: সুদ অবৈধ।


‘হে ঈমানদারগণ, তোমরা সুদ খেও না, দ্বিগুন, চতুর্গুণ এবং আল্লাহকে ভয় কর। আশা করা যায় তোমরা সফল হবে।’(৩:১৩০)

সুদকে অবৈধ ঘোষণা করে এই আয়াত নাযিল হওয়ার পূর্বে আরবে ব্যাপকভাবে সুদী কারবারের প্রচলন ছিল। সুদ (Interest) গ্রহণের সাধারণ রীতি ছিল এই- একটি নির্দিষ্ট সুদের হারে নির্দিষ্ট সময়ের জন্যে নেয়া ঋণ যথাসময়ে সুদসহ পরিশোধে ব্যর্থ হলে, সময় বাড়ান হত সুদাসলকে মূলধন ধরে ঐ নির্দিষ্ট সুদের হারে অর্থাৎ চক্রবৃদ্ধি হারে। 

মক্কা বিজয়ের পর বনি মখযুম গোত্র ইসলাম গ্রহণ করল। এই মখযুম গোত্র ও বনি সকিফ গোত্রের মধ্যে সুদী কারবার ছিল। অতঃপর সুদকে অবৈধ ঘোষণা করে কোরআনের উপরোক্ত আয়াত নাযিল হলে, বনি মখযুম বনি সকিফদের প্রাপ্য সুদের টাকা পরিশোধ করাকে অবৈধ বলে মনে করল। আর বনি সকিফরা যেহেতু মুসলমান ছিল না, সুতরাং তারা তাদের প্রাপ্য সুদ দাবী করতে লাগল। আর তারা উপরোক্ত আয়াতের বিরোধীতা করে বলল, ‘ক্রয়-বিক্রয়ও তো সুদ নেয়ার মত। তাহলে ক্রয়-বিক্রয়ও কি অবৈধ?’ 

তখন তাদের প্রশ্নে জবাবে এই আয়াতসমূহ নাযিল হল-‘যারা সুদ খায়, তারা কেয়ামতে দন্ডায়মান হবে, যেভাবে দন্ডায়মান হয় ঐ ব্যক্তি, যাকে শয়তান আছর করে মোহাবিষ্ট করে দেয়। তাদের এ অবস্থার কারণ এ যে, তারা বলেছে, ক্রয় -বিক্রয়ও তো সুদ নেয়ার মত। অথচ আল্লাহ ক্রয়-বিক্রয়কে বৈধ করেছেন এবং সুদ হারাম করেছেন। অতঃপর যার কাছে তার পালনকর্তার পক্ষ থেকে উপদেশ এসেছে এবং সে বিরত হয়েছে, পূর্বে যা হয়ে গেছে, তা তার। তার ব্যাপার আল্লাহর উপর নির্ভরশীল। আর যারা পুনরায় সুদ নেয়, তারাই জাহান্নামে যাবে। তারা সেখানে চিরকাল অবস্থান করবে। আল্লাহ সুদকে নিশ্চিহ্ন করেন এবং দান খয়রাতকে বর্ধিত করেন। আল্লাহ পছন্দ করেন না কোন অবিশ্বাসী পাপীকে।’(২:২৭৫-২৭৬)

মক্কা বিজয়ের পর নবীজী মু‘আজকে মক্কার শাসক নিযুক্ত করেছিলেন। বনি সকিফ তাদের প্রাপ্য সুদ আদায়ে ব্যবস্থা গ্রহণ করতে তাকে অবহিত করল বিষয়টি। তখন তিনি এ বিষয়ে কি করনীয় তা জানতে নবীজীকে এক পত্র দিলেন। 

এরই পরিপ্রেক্ষিতে এই আয়াত নাযিল হল- ‘হে ঈমানদারগণ, তোমরা আল্লাহকে ভয় কর এবং সুদের যে সমস্ত বকেয়া আছে তা পরিত্যাগ কর, যদি তোমরা ঈমানদার হয়ে থাক।’(২:২৭৮)

নবীজী বিদায় হজ্জ্বের ভাষণে এই ইসলামী আইন মেনে চলতে সকলকে আহবান জানালেন, বললেন- ‘খোদায়ী এ আইন ব্যক্তি বিশেষ, সম্প্রদায় বিশেষ কিম্বা মুসলমানদের আর্থিক স্বার্থের প্রতি লক্ষ্য করে নয়; বরং সমগ্র মানব জাতির উন্নতি ও কল্যাণের প্রতি লক্ষ্য রেখেই প্রবর্তিত হয়েছে। তাই আমি সর্বপ্রথম অমুসলিমদের কাছে মুসলমানদের প্রাপ্য বকেয়া সুদের অঙ্ক মওকুফ করে দিচ্ছি। এখন তাদের নিজ নিজ বকেয়া সুদের অঙ্ক ছেড়ে দিতে আপত্তি থাকা উচিৎ নয়।’ 

এই ইসলামী আইন কার্যকর হওয়ায় মুসলমানরা তো তা মানতে বাধ্য ছিলই, যেসব অমুসলিম গোত্র মুসলমানদের সাথে শান্তি চুক্তিতে আবদ্ধ হয়ে ইসলামী আইন মেনে নিয়েছিল, তারাও এই আইন মেনে নিতে বাধ্য হল। যদিও অমুসলিমদের পক্ষে বিষয়টি মেনে নেয়া যথেষ্ট কষ্টসাধ্য ছিল। নিচের এই আয়াত দ্বারা এই নির্দেশের বিরুদ্ধাচারণকারীদেরকে কঠোর শাস্তির কথা শুনান হয়েছে। আয়াতটি এই-অতঃপর যদি তোমরা তা পরিত্যাগ না কর, তবে আল্লাহ ও তাঁর রসূলের সাথে যুদ্ধ করতে প্রস্তুত হয়ে যাও। কিন্তু যদি তোমরা তওবা কর, তবে তোমরা নিজের মুলধণ পেয়ে যাবে। তোমরা কারও প্রতি অত্যাচার কোরও না এবং কেউ তোমাদের প্রতি অত্যাচার করবে না। যদি খাতক অভাবগ্রস্থ হয় তবে তাকে সচ্ছলতা আসা পর্যন্ত সময় দেয়া উচিৎ। আর যদি ক্ষমা করে দাও, তবে তা খুবই উত্তম, যদি তোমরা উপলব্ধি কর।(২:২৭৯-২৮০)

রিবা শব্দটি ইসলামপূর্বকালে আরবীয়গণ ব্যবহার করত to refer to an increase. আর ক্লাসিক্যাল ইসলামিক আ্ইনশাস্ত্রে রিবা সংজ্ঞায়িত হয়েছে "surplus value without counterpart" হিসেবে। রিবার অন্তর্ভূক্ত-

  • unjustified increment in borrowing or lending money, paid in kind or in money above the amount of loan, as a condition imposed by the lender or voluntarily by the borrower. Historically Islamic legal scholars have interpreted the Quran as "prohibiting any loan contract that specifies a fixed return to the lender" on the grounds that it provides "unearned profit to the lender" and imposes "an unfair obligation on the borrower." In the modern era most Muslim countries allow moderate interest rates (some banning compound interest), while Islamists and revivalists" preach that all interest is socially unjust and should be banned;[Esposito, John L.   • all forms of interest charged on loans
